LODGING
AGREEMENT - 32326 Hidden
Acres Drive Lane, Clarksville, DE 19945: This contract is not legally binding or effective until signed by tenant(s) and deposit for rent is received by Owner. It is agreed that the Property described as 32326 Hidden Acres (hereinafter Property) will be used by Guest solely as a private dwelling and not for commercial purposes for the use of Guest, his/her family and invitees. The Property may be used only the number of persons listed as "Occupancy Limit" in the amount of 9 (nine) guests. Any number exceed occupancy limit overnight may be cause for termination of this Agreement with no refund of rent to Guest. Guest may neither sublet the Property nor assign this Agreement. Guest must sign the Agreement prior to the rental term. The Owner has the right to refuse occupancy to anyone attempting to sign in who is not the Guest designated herein. "Time is of essence" for all payments and check in/check out dates/times referenced herein. It is agreed that full payment is due 15 days prior to check-in. If Guest has not checked in within 48 hours of the arrival date, or notified Owner in writing of delayed check-in, the reservation will be canceled and entire rental amount forfeited. If you made your Reservation
within 5 days of Check-in Date, than your entire Rental
Amount + Security deposit is due either: (1) Cash at
check-in, (2) Money Order at check in, (3) Wire Transfer
at least 2 days prior to check in, or (4) PayPal
INSTANT TRANSFER/Credit
Cards (see
home page) at least 2 days prior to check in. It is agreed that
Owner or a service provider retained by Owner, may enter the
premises at 10:00 AM on the date this Lodging Agreement terminates
and may remain on the premises until 5:00 PM on the date that this
Lodging Agreement commences, for cleaning and/or repair, or at any
time in an emergency. Guest agrees to surrender possession of the
property promptly at check-out time. There will be a minimum charge
of $25.00 for late check-outs. Guest agrees she/he
is personally responsible for any damage to the Property caused by
Guest or his/her family, invitees, reasonable wear excepted. Property Owner
agrees that, to the best of their knowledge and belief, the Property
complies with the statues, rules and regulations of governmental
authorities.
Guest agrees that he/she will,
immediately, upon taking possession, make an
inspection of the Property and promptly report to Owner any defects
and/or damages to/in the Property requiring repair,
especially any Property conditions which may cause injury or
otherwise present a safety hazard. Further, Guest hereby agrees to
hold harmless and indemnify the Owner against any damages by anyone
as a result of any defecting and/or unsafe condition on/in/around
the Property. In the event Guest
cancels this Agreement, Guest shall be responsible to the Owner for
the full amount of rent owed under this Agreement. However, if Owner
is able to find a new Guest for the same period, at the same or
better rates as provided by this Agreement, the deposit will be
returned to Guest less a replacement fee of 10% of the total
Agreement rental amount. All cancellation requests must be in
writing. No refunds will be given for inclement weather, including
hurricanes, beach replenishment; or for any other circumstances
beyond the control of the Owner. If, during the term
of this Agreement, the Property and/or any building in which it is
located, is so damaged by fire or other casualty without fault or
negligent of the Guest, such that it is rendered unfit for
occupancy, this Agreement shall terminate and the prorated balance
of the rent shall be returned to Guest. If the Property is damaged
prior to occupancy and cannot be made ready by the beginning date of
this Agreement, this Agreement shall terminate and the deposit will
be returned in full. Guest acknowledges
that the Delaware Landlord-Tenant Act does not apply to short term
rental agreement of less than 120 days and agrees to conform to any
covenants and restrictions (which may be posted in the property) and
municipal and state laws which apply to the Property. Violation of
such rules, regulations or laws or engaging in objectionable
behavior in, on, or around the Property may be grounds for eviction
of Guest, Guest’s family members and/or invitees without refund of
rent. Guest agrees that, upon request from the Owner, to vacate the
Property promptly. Any time prior to
taking of possession of the Property, both the Owner and Guest agree
that for any reason whatsoever, at its sole discretion, without any
liability whatsoever, Owner may void this Agreement and return any
rent paid by the Guest. NO ANIMALS OF ANY
KIND shall be kept or harbored on the Property unless you have
received specific written authorization from the Owners. Violation
of this rule may be grounds for immediate eviction with no refund of
rent to Guest. Guest must furnish
linens, blankets, towels, soap, and paper products. It is mutually agreed
that this is a legally binding contract; any action by either party
arising out of the Agreement or to enforce this Agreement shall be
brought in Sussex County, Delaware and shall be governed by the laws
of the State of Delaware. It is also agreed that under no
circumstances will the liability of the Owner, exceed the full
rental amount owed by Guest under this Agreement. If this Agreement
and/or any terms herein, are litigated, all costs and fees,
including reasonable attorney’s fees of the prevailing party shall
be borne by losing party. To the extent that
Property is located in a facility which allows grills or barbecues,
grilling may not take place in the Property, but only in open air
places which are designated or set aside for grilling purposes. In the event that
there are no outstanding damages or expenses incurred to repair or
clean the Property (including any telephone or cable charges), after
the Guest’s possession of same hereunder, the security deposit will
be returned to the Guest, First Class United States Mail within a
reasonable period of time not to exceed thirty days after the Guest,
Family Members and/or Guest invitees cease to occupy the Property. There will be a
$25.00 fee for lockouts after the hours of 8:00 PM.
